1. About this policy
BackHome ("BackHome", "we", "us", "our") is operated by Kaya Virtual (ABN 84 263 783 878), based in Canberra, Australia.
We are currently in a pre-launch phase. We are collecting expressions of interest from people who may want to use our service in future, and speaking with families to understand what would be useful. We are not yet delivering services.
This policy explains what personal information we collect, why we collect it, how we handle it, and what rights you have.
We handle personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles. Because our intended service operates in the Philippines, we also aim to handle personal information consistently with the Philippine Data Privacy Act of 2012 (RA 10173).
2. What information we collect
Information you give us directly
When you express interest through our website, we may collect:
- Your full name
- Your email address
- Your phone or WhatsApp number (optional)
- The country you currently live in
- The area in Cebu where your family or property is located
- Your relationship to the person or people you are asking about
- A free-text description of your situation
- Which service you would be most likely to use
- Whether you consent to a short research call
- Whether you consent to us contacting you about BackHome
Information about other people
Our form asks about your family situation. In answering, you may give us information about other people — often an elderly parent or relative in Cebu.
This is important. That person has not filled in our form and has not consented to us holding information about them. Before you tell us about someone else, please consider whether they would be comfortable with that. Share only what is necessary, and avoid sensitive details such as medical diagnoses, medication, or financial information at this stage.
If we later begin providing services, we will ask for that person's consent directly where it is practicable to do so, and we will explain to them what we hold and why.
If you are that person, or you act for them, and you would like to know what we hold or ask us to delete it, contact us using the details in section 12.
Information collected automatically
When you visit our website we may collect standard technical information such as your IP address, browser type, device type, referring page, and pages viewed. We use this to understand how the site is used and to keep it working properly.
3. Why we collect it
We use personal information to:
- Contact you about the Cebu pilot and let you know when places open
- Understand what support families actually need, so we design the right service
- Arrange and conduct short research conversations, where you have agreed to one
- Assess where in Cebu we should operate first
- Improve our website
- Meet our legal obligations
We do not sell personal information. We do not share it with advertisers.
4. Consent and how to withdraw it
We rely on your consent to contact you about BackHome. You gave that consent by ticking the relevant box on our form.
You can withdraw it at any time by emailing us, or by using the unsubscribe link in any email we send. Withdrawing consent will not affect anything we did lawfully before you withdrew it.
Agreeing to a research call is separate and optional. You can decline a call and still stay on our list.
5. Who we share information with
We may share personal information with:
- Service providers who help us operate — for example email delivery, form handling, cloud hosting, and analytics. These providers act on our instructions.
- Local coordinators in the Philippines, once services begin, and only to the extent needed to carry out a task you have asked for.
- Professional advisers such as lawyers or accountants, where necessary.
- Government or law enforcement, where we are required by law.
We will tell you before we share your information in any way not described here, unless we are legally prevented from doing so.
6. Sending information overseas
BackHome operates between Australia and the Philippines. Personal information you give us may be stored or accessed in either country, and our service providers may store data in other countries including the United States.
Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with this policy and with applicable privacy law. Data protection laws in other countries may not be the same as those in your own.
7. Security
We take reasonable steps to protect personal information from misuse, loss, unauthorised access, modification, and disclosure. These include access controls, encryption in transit, and limiting access to people who need it.
No system is completely secure. If a data breach occurs that is likely to cause serious harm, we will notify affected people and the relevant regulator as required by law.
8. How long we keep it
We keep expression-of-interest information for as long as needed to run the pilot and follow up with you, and for a reasonable period afterwards.
If the pilot does not proceed, or you ask us to remove you, we will delete or de-identify your information within a reasonable time, unless we are required to keep it by law.
Notes from research conversations are kept in de-identified form where possible.
9. Your rights
You can ask us to:
- Access the personal information we hold about you
- Correct it if it is wrong or out of date
- Delete it, subject to any legal obligation we have to keep it
- Stop contacting you
- Object to or restrict certain uses
- Receive a copy of information you gave us, in a usable format
We will respond within a reasonable time and will not charge you for making a request. We may need to verify your identity first.
10. Cookies and analytics
Our website may use cookies and similar technologies to keep the site working and to understand how it is used. You can block or delete cookies in your browser settings, though some parts of the site may not work as well.
11. Children
Our website and service are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us personal information, contact us and we will delete it.
