1. About these terms
These terms apply to your use of the BackHome website and to expressing interest in our Cebu pilot.
BackHome is operated by Kaya Virtual (ABN 84 263 783 878), based in Canberra, Australia.
By using this website or submitting our form, you agree to these terms. If you do not agree, please do not use the site.
2. We are not operating yet
BackHome is in development. We are not currently delivering services.
This means:
- Nothing on this website is an offer to provide services
- Submitting the form does not create a contract, book anything, or guarantee you a place
- Services described on the site are being considered, not committed to
- Details including pricing, service scope, and coverage area may change or may not proceed at all
- The pilot may be delayed, changed, or cancelled
We will describe our services accurately as they develop, but you should not rely on anything here as a promise of future service.
3. Who can use this site
You must be at least 18 years old.
4. Expressing interest
When you submit the form, you are telling us you may want to use BackHome in future and giving us permission to contact you about it.
You can withdraw at any time by emailing us or using the unsubscribe link in any email.
No payment is required to express interest, and we will not ask for payment details at this stage.
5. What BackHome is not
Even once operating, BackHome is a coordination service. It is important you understand what that does and does not mean.
BackHome does not provide:
- Emergency response of any kind
- Medical advice, diagnosis, treatment, or nursing care
- Regulated clinical services
- Legal or financial advice
- Guardianship, power of attorney, or legal decision-making for another person
In an emergency, contact local emergency services directly. In the Philippines, dial 911.
Where a task requires a qualified professional — medical, legal, trades, or otherwise — we will arrange a suitably qualified provider. We are not that provider.
6. Your responsibilities
When you give us information, you agree that:
- It is accurate and current, as far as you know
- You have the right to share information about other people. If you tell us about a parent or relative, you confirm you have a reasonable basis to share it and that they would not object. This matters — the person you are telling us about has not agreed to anything themselves.
- You will not share sensitive details about another person beyond what is necessary
- You will not use this site unlawfully, or to harass, impersonate, or mislead
7. Respect for the people we would be helping
Our service is built on the idea that support should feel helpful and dignified, not intrusive or controlling.
If we begin operating, we may decline a request that we believe would be against the interests or wishes of the person it concerns, that would involve monitoring someone without their knowledge, or that would be unsafe or unlawful.
8. Communications
By submitting the form, you agree we may contact you by email, phone, or WhatsApp about the pilot.
We will not use your details for unrelated marketing without your permission, and you can opt out at any time.
9. Intellectual property
All content on this site — text, design, logo, illustrations, and code — belongs to BackHome or is used with permission. You may not copy, reproduce, or reuse it without our written consent, other than viewing it normally.
"BackHome" and our logo are our trade marks.
10. Third parties
Once operating, we may engage local providers, tradespeople, healthcare professionals, and other third parties to carry out tasks.
We take reasonable care in selecting providers, but we do not control their work and are not responsible for their acts or omissions, except as required by law.
11. No warranties
This website is provided on an "as is" basis. We do not guarantee it will be available without interruption, error-free, or that information on it is complete or current.
Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded.
12. Limitation of liability
To the extent permitted by law, BackHome is not liable for indirect, incidental, or consequential loss arising from your use of this website or from expressing interest in the pilot.
Where liability cannot be excluded, our liability is limited to resupplying the relevant service or paying the cost of having it resupplied.
13. Changes and availability
We may change these terms as our service develops. The updated version will be posted here with a new date. Continuing to use the site after a change means you accept it.
We may modify, suspend, or discontinue the website or the pilot at any time.
14. Governing law
These terms are governed by the laws of the Australian Capital Territory, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of the Australian Capital Territory.
If any part of these terms is unenforceable, the rest continues to apply.
